POCATELLO — A 65-year-old local man was recently arrested after police say he sent sexually explicit text messages to a teenage girl and, on a separate occasion, laid on top of her while making inappropriate movements.

Eduardo Nabor Laythe, of Pocatello, has been charged with two felony counts of sexual battery of a minor child, according to police and court records the Idaho State Journal recently obtained.

The investigation began around 2 a.m. on April 24 after Pocatello police were dispatched to a Pocatello home for a report of a family dispute.

Upon speaking with the teenage girl, she disclosed to officers that Laythe had sent her inappropriate text messages and had previously engaged in unwanted physical contact of a possible sexual nature, police said.

Officers collected digital evidence of the text messages.

A follow-up investigation was conducted later that morning, with detectives and a representative from the Department of Health and Welfare accompanying officers to the residence.

During the follow-up, officers confirmed that the phone number associated with the text messages belonged to Laythe, police said.

The text message exchange, dated Nov. 9, 2024, was reviewed by officers. In the messages, Laythe made sexually suggestive comments directed at the girl and referenced leaving physical marks on her body, police said. The girl was 16 years old at the time of the exchange, and Laythe was 64, according to court records.

The girl also described a separate incident that occurred around October 2025, in which she and Laythe were watching a movie together. She told police he placed his head on her lap while she was fully clothed, then got on top of her on the ground before stopping. She said she moved away from him to create distance and that he followed her to the floor and laid on top of her for approximately a couple of minutes, police said.

Laythe was taken into custody at the residence and transported to the Pocatello Police Department, where he was interviewed.

Laythe told officers he had sent the text messages but denied any sexual intent, saying he was trying to make the girl feel better about her appearance. He denied ever touching her in a sexual manner. Regarding the physical incident, he said his head may have been in her lap while watching movies but denied making the movements she described.

Laythe was subsequently transported to the Bannock County Jail in Pocatello.

A forensic interview for the girl was subsequently scheduled at the Bright Tomorrows child advocacy center, and search warrants were sought for cell phones seized as evidence, police said.
