Authorities: East Idaho man admits to raping 12-year-old girl

An Arco man was arrested Thursday after he reportedly admitted to sheriff's deputies that he raped a 12-year-old girl.

Denilson Jared Diaz-Garcia, 20, reportedly raped the victim after she came over to his residence. The victim's father walked in on the sexual assault while looking for his daughter at the residence.

Both Diaz-Garcia and the victim said the victim snuck out of her residence to go to Diaz-Garcia's trailer.

The affdavit does not state whether Diaz-Garcia physically forced the victim into sex. Under Idaho law, juveniles cannot consent to sex and sex between an adult and a juvenile is a crime by the adult, unless they are apart by less than three years of age.

Diaz-Garcia was charged with lewd conduct with a minor, punishable with up to life in prison. A no-contact order was issued between him and the victim, and his bond was set at $250,000.

A preliminary hearing is scheduled for 1 p.m. Jan. 13 in Bonneville County Court.
