Mitch Fisher says he was just trying to help when he plowed the snow-covered street in front of his elderly neighbor’s driveways after a nasty winter storm dropped several inches of snow in January.

But instead of getting a pat on the back, Mitch was slapped with a $206 citation.

Fisher was issued the citation for depositing snow onto a city road. Pocatello city code states, “it is unlawful for any person to deposit, place or allow to remain in or upon any public right of way any material or substance injurious to persons or property.”

Fisher, however, contends that’s not what he was doing. He says he took snow that was built up in front of his neighbor’s driveway and moving it up against the curb.

“He moved no snow from the sidewalk or the driveway into the street,” said neighbor Carol Wardrip. “He only moved street snow to one side so that we could exit our driveways. I don’t know what I’d do without him.”

Fisher’s story gained nationwide attention, and in late February, his citation was dropped — though court records did show he paid a $75 fine.

Attorney Paul Echo Hawk took up the case pro bono and negotiated to have the charges against Fisher dismissed.

“For what he was trying to do, I didn’t feel like he deserved criminal punishment,” Echo Hawk said.

Said Fisher, “It helped that so many people were behind me. It was heartwarming, and I’d like to thank everybody.”
