POCATELLO — A former California man, now living in Montana, pleaded guilty in Sixth District Court Monday to a reduced charge of felony possession of a controlled substance with intent to deliver.

Anthony Woody was arrested in March and charged with felony counts of trafficking in marijuana and possession of a controlled substance. He was also hit with who enhancements, one charging him with a second or subsequent drug offense and another charging him with being a persistent violator.

As part of a plea agreement, Woody pleaded guilty to the reduced charge and prosecutors dismissed the original four charges.

During the process of accepting the plea, Sixth District Judge Robert Naftz asked Woody about the incident during which he was arrested.

Woody explained that he was estranged from his wife in California and living on the streets when his brother, who was visiting from Montana, offered to bring him back and let him live in his home. Woody accepted, telling the judge there was nothing for him in California at the time.

He said the drugs were not his, but did say he knew they were in the vehicle. But Woody also told the judge he didn’t become aware the marijuana was in the vehicle until they were well on their way to Montana.

Naftz accepted Woody’s guilty plea and set his sentencing for Oct. 22.
