BOISE — Attorney General Raúl Labrador won a unanimous 9th Circuit Court of Appeals victory affirming dismissal of The Satanic Temple’s federal lawsuit challenging Idaho’s Defense of Life Act. The three-judge panel upheld a district court ruling that dismissed the case for lack of standing.
“I will always defend Idaho’s laws that protect families and preserve the sanctity of life,” said Attorney General Labrador. “The 9th Circuit Court of Appeals correctly found that the plaintiff lacked standing to challenge Idaho’s laws protecting mothers and their unborn children. This victory ensures that Idaho may continue to enforce our pro-life and pro-family protections.”
The Satanic Temple filed the federal lawsuit in 2022 challenging Idaho’s Defense of Life Act, arguing that requiring women to carry pregnancies to term constitutes slavery under the 13th Amendment and violates property rights under the Fifth Amendment’s Takings Clause.
A federal district court dismissed the case for lack of standing in early 2024, and The Satanic Temple appealed. This week’s 9th Circuit ruling affirmed that dismissal.
The Court ruled that The Satanic Temple lacked both associational and organizational standing to challenge Idaho’s laws. The organization failed to identify any specific Idaho member harmed by the law, instead presenting statistical estimates claiming 27 members might become “involuntarily pregnant” annually. The court ruled these projections too speculative to establish standing. The court also rejected the plaintiff’s argument that spending money on an abortion clinic the organization owns and operates in New Mexico created standing to challenge Idaho’s law.
The case was remanded to determine whether The Satanic Temple could amend its complaint to address the standing deficiencies identified by the court.

"Attorney General Labrador claims victory over Satan, again." The title is very telling in itself since the argument has to do with Roe vs Wade. There are many legal mistakes in the argument. The article maintains that the supreme court overruled Roe vs Wade. The Supreme Court did not overrule Roe vs Wade. The supreme court gave that decision to the lower courts, the lower courts in this case be the State Courts. States now protecting Pro choice and Family Planning are California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland,
Massachusetts, Nevada, New Jersey, New York, Oregon, Rhode Island, Vermont, Washington, and Washington D.C.
The states where the greatest abuses of women's rights have been in effect may be considered those committed to every manor of civil right violations, not only against women but minorities in general:
Alabama, Arkansas, Idaho, Indiana, Kentucky, Louisiana, Mississippi, Oklahoma, South Dakota, Tennessee, Texas, and West Virginia. These states like Alabama, Arkansas, Louisiana, Mississippi, Tennessee, had Black Codes on the books which deprived minorities and immigrants from voting. Everyone is familiar with the Little Rock Nine episode from 1957 when the Governor brough out the State national Guard to deprive 9 black children from integrating Little Rock High school. Eisenhower brought out the Federal National Guard to protect the children from the white supremist torture and uphold the Supreme Court ruling of Brown v. Board of Education against segregated schools. Oklahoma had the darkest episode of genocide by white supremist that killed between 150-200 blalck people and destroyed the property of the wealthiest black business district in the country in 1921. Oklahoma Legislature has propounded that the 2020 election was stolen by Biden and Trump was justified in orchestrating a riot to overthrow the election and blackmail his Vice President Pence for not negating the electorate.
The Posse Comitatus Act of 1878 directly prohibits the use of the military against American citizens. Trump has violated that law by ordering national Guard into L.A without expressed permission of the governor a clearly impeachable Act, a violation of the rights of American citizens. Trump now initiates the National Guard against the citizens of Washington D.C under the pretense of protecting tourism, but in effect to protect demonstrations against his flagrant abuse of power in issuing executive orders to renaming the Kennedy Center the Trump Center. Trump a Republican snake oil salesman wanting to name the Kennedy Center after himself. Kennedy a man who fought in WW11 and gave his life in the service of his country. Trump knows the demonstrations would be huge.
It is just another cover up for his involvement with Epstein who many believe without direct evid3ence that Trump had murdered in a cover up.
The Idaho brag by Labrador is in religious conjunction with states like West Virginia which is now the only state in the union where snake handling is legally practiced by ministers in church services justifying Bible verse proclaiming snake handling a sign of redemption
