POCATELLO — The 24-year-old man accused of firing a weapon into the driver’s side door of Pocatello police cruiser waived his right to a preliminary hearing Monday.

Zachary Davis was charged with aggravated assault with a deadly weapon following a police stop on Oct. 13.

Davis will be arraigned in District Court next week.

According to court records, arrest warrants for Davis for grand theft and forgery were issued on Aug. 10.

Officers stopped Davis on Shore Road on Oct. 13 and he opened fire, striking the driver’s side door of the patrol car. Then he fled on foot.

Davis was arrested at Common Cents on South Fifth Street the following morning. And police located the weapon used in the shooting about two hours later.

Along with the weapons charge, Davis is also facing three counts of aggravated assault with a deadly weapon and attempting to elude police. He pleaded not guilty to those charges and a jury trial is scheduled in the case on Jan. 2, 2016.

Davis remains incarcerated at the Bannock County Jail. The total cash bond for four of the charges against him is $200,000. But he is being held without bond on at least two of the counts against him.

A preliminary hearing allows the judge to determine whether the prosecution has enough probable cause or evidence against the defendant to send the case for trial. When a defendant waives the hearing, the case is bound over directly to the trial court.

Davis was in good spirits Monday. He wished prosecutors a happy holiday. And when Sixth District Magistrate Scott Axline asked if he was voluntarily waiving the preliminary hearing, the defendant told them a plea deal was in the works.

Bannock County Deputy Prosecutor Jared Johnson said there have been preliminary discussion regarding a plea agreement in the case, but so far no deal has been struck.
