An 18-year-old Idaho Falls man faces four felony counts of aggravated assault with a deadly weapon for allegedly threatening four people, three of whom are teenagers, by pointing a gun at them Monday night in a parking lot near the McDonald’s restaurant in Ammon.

Creek Warren Potter faces a maximum sentence of five years imprisonment, a $5,000 fine, a $5,000 compensatory fine and restitution on each count, according to court records.

Bonneville County Sheriff’s deputies responded to a report of a person pointing a gun at multiple people while driving through the lot around 9 p.m. near the McDonald’s at 1875 South 25th East.

According to the affidavit of probable cause, the contacted party told deputies the suspect drove through the lot multiple times while a group of friends were standing there. The last time the suspect drove through he allegedly pointed a black handgun out the driver-side window at four people. The witness confirmed all four people saw a gun pointed at them.

Deputies were shown photos of the vehicle and its license plate driving through the lot, who then contacted Potter at his residence, according to court records. A vehicle in front of the residence matched the description and photos from witnesses.

Potter told deputies he went to McDonald’s after leaving work nearby and then went straight home. He also said he didn’t know the group of people in the lot.

He confirmed that he had a gun under the seat in his vehicle, according to the affidavit. Potter’s mother retrieved a Springfield Hellcat Pro handgun from his bedroom safe with his consent. The gun matched the description from the alleged victims. A deputy cleared, secured and entered the gun as evidence. Potter was given a receipt for the gun and was transported to the Bonneville County Jail and booked.

Court records show Potter was released on a $10,000 bond and ordered to have no contact with the alleged victims. He also must not possess any firearms.

A preliminary hearing has been set for 1 p.m. Tuesday, Aug. 11 before Magistrate Judge Wiley R. Dennert at the Bonneville County Courthouse in Idaho Falls.
