An Idaho Falls teenager is being charged as an adult for allegedly raping a 13-year-old girl on April 9 in Bonneville County.

Zaiden C. Evans, 17, is scheduled to have a preliminary hearing before Magistrate Judge Michael A. Kirkham at 1 p.m. Tuesday, Feb. 10 in the Bonneville County Courthouse. The alleged victim lives in California and will appear via Zoom for the hearing, according to court documents.

Evans faces a maximum sentence of life imprisonment, a $50,000 fine, $5,000 compensatory fine and restitution for the felony charge.

Deputies were dispatched to a residence on April 9 for a reported sexual assault made by the stepgrandfather of the alleged victim, who was living in Bonneville County at the time. The girl’s mother had informed the stepgrandfather of the assault, according to the affidavit of probable cause.

The alleged victim told deputies that she snuck out of her residence in the early morning hours of April 9 to meet an unnamed 16-year-old boy and was picked up by Evans and him.

They went to the residence where the 16-year-old resided. After arriving the girl told deputies she had consensual sex with the 16-year-old. She then said Evans forced himself on her, despite allegedly telling him to stop multiple times. She said she was unable to fight him off, according to the affidavit.

After the alleged assault, the girl was taken back to her stepgrandfather’s residence at 3:30 a.m. A deputy later collected the clothes she had worn.

DNA results received from the sexual assault examination of the girl showed she had two different male DNA profiles on her body.

A warrant for DNA swabs of Evans was served on Sept. 25, according to the affidavit. The resulting DNA report showed that DNA from Evans was found in two spots on the girl.

Evans was released to pretrial services on Jan. 14, according to court documents.

In felony or more serious misdemeanor cases against a juvenile, the court may transfer the case to the district court to be processed under adult criminal law. Under Idaho Code, the juvenile must be at least 14 years of age to be tried as an adult. There are also mandatory waivers for certain crimes allegedly committed by a juvenile. Rape is one such crime.
