POCATELLO — A local judge denied a request Monday of leniency for a man he sentenced to ten years for intimidating a witness and attempted strangulation.

    Robert F.J. Huber was arrested in July of 2011 after he came into the Pocatello Police Department for an interview regarding an alleged incident between him and a woman three days earlier. He was subsequently arrested and charged with eight felonies, including one count each of first-degree kidnapping, domestic battery, attempted rape, aggravated assault and intimidating a witness, and three counts of attempted strangulation.

    In April, he pleaded guilty to intimidating a witness and attempted strangulation as part of a plea agreement with prosecutors, who dismissed the other charges.

    Sixth District Judge Robert Naftz sentenced Huber to three years fixed and two years indeterminate for the intimidating a witness conviction and three years fixed and seven years indeterminate for attempted strangulation.

    Huber’s attorney, John Souza, was back in front of Naftz on Monday for a Rule 35 motion, requesting a reduction in the fixed portion of his client’s sentences. His request was based on leniency.

    Naftz denied the request.
