POCATELLO — A 38-year-old local woman was arrested on felony stalking charges Friday after police say she pounded on a shared wall, screamed death threats at her neighbor and dared her to “call the cops” — all while an active protection order between the two women was in place.

Whitney Kristin Smiddy, of Pocatello, has been charged with first-degree stalking following an incident that led to her arrest around 11:30 p.m. Friday, according to police and court records the Idaho State Journal obtained Monday.

Smiddy and the victim live in a duplex and share an adjoining wall.

A temporary protection order signed June 18 by 6th District Magistrate Judge Aaron Thompson prohibited Smiddy from having verbal communication with the victim — explicitly including “no yelling through walls” — and from harassing or threatening her, according to court records. The order, which listed the victim and her two small children as protected parties, was valid through June 30, police said.

Over the three days preceding the arrest, the victim had contacted Pocatello police multiple times reporting Smiddy was violating the protection order, according to the police report. On June 27, Smiddy began pounding on the adjoining wall and yelling when the victim and her children arrived home, police said.

The victim provided officers with recordings of Smiddy yelling through the wall, including statements that she was going to kill the woman next door and “I dare you to call the cops,” according to the police report. The victim also told police Smiddy had threatened to burn the duplex down with everyone inside, police said.

Officers arrested Smiddy for first-degree stalking and transported her to the Bannock County Jail, according to court records.

Smiddy appeared before 6th District Magistrate Judge David A. Hooste via video conference from the Bannock County Jail for an arraignment hearing Monday where prosecutors requested her bond be set at $25,000.

Smiddy is scheduled to appear in court again July 13 for a preliminary hearing. Prosecutors will attempt to present sufficient evidence to elevate the case from magistrate to district court for trial.

If convicted of felony first-degree stalking, Smiddy faces no less than one year and up to five years in prison and a fine of up to $10,000.
