POCATELLO - A local man who drove through a Chubbuck Fire Department roadblock in July and nearly struck a firefighter was denied reconsideration of his probation revocation Monday.

Robert B. Galloway, 49, had his felony DUI probation revoked in October for the July incident. Galloway, who was reported to have been highly intoxicated, drove past a roadblock on Philbin Road and through a Chubbuck Fire Department grass fire response. Galloway was later located on the Fort Hall reservation and was taken into custody by the Idaho State Police.

Chubbuck Fire Chief Eric King said after the July incident that a radio warning by a search and rescue member enabled him to warn the fireman about Galloway's rapidly approaching vehicle.

"By the time we got the message, he was almost at our trucks," King said. "I yelled at the guy who was rolling up the hose and he just had enough room to get up and he leaned up against the fire truck. He just missed him by a few feet. He actually hit the hose that the firefighter was rolling up."

During Monday's Rule 35 hearing seeking leniency, Galloway's attorney, John Souza, asked Sixth District Judge Peter D. McDermott to reconsider the revocation and imposition of the two-year fixed, three-year indeterminate sentence. He said Galloway has come to grips with his alcoholism and is sincere about recovery. He also indicated that Galloway's drinking stemmed from attempts to control pain from the amputation of his lower left leg. Souza said Galloway is now keeping his pain under control with proper medication.

"I can't take a chance again with him on probation," Sixth District Judge Peter D. McDermott said. "I think the guy's a menace to society."

Galloway was on probation for a 2006 DUI in Bannock County when the July incident occurred. He was charged with another felony DUI for the incident by the Bingham County Attorney's Office. Galloway has pleaded guilty to that DUI but has not yet been sentenced. He is currently in the custody of the Idaho Department of Correction.
