CHUBBUCK — A 22-year-old local man was recently arrested after police say he broke into a Chubbuck apartment, assaulted the resident, stole a guitar and slashed the victim’s tire before fleeing the scene.

Devon Rick Stoor, of Chubbuck, has been charged with felony aggravated assault, felony burglary, misdemeanor malicious injury to property and misdemeanor petit theft following an investigation that began after a man reported an assault at his apartment on Adams Street, according to police and court records the Idaho State Journal recently obtained.

Chubbuck police responded to the apartment around 2 p.m. Tuesday after the victim called 911 to report that someone had broken into his apartment and attacked him, police said. The man told dispatch he had a gun, that he and the suspect — later identified as Stoor — had wrestled over it, and that he was unsure where Stoor or the firearm had gone, according to the report.

Responding officers established a perimeter around the residence while dispatch remained on the phone with the victim, who said he was trapped in his bedroom and was unsure if Stoor was still inside, according to the report.

Officers deployed rifles and cleared the downstairs apartment where the man was located. His bedroom door had to be kicked open to reach him and a female witness inside, according to the report.

The man told officers he heard knocking at his door and assumed it was for someone else, as he had just come off a night shift. He said he had not yet gotten up to answer when Stoor barged into his bedroom. He closed the door thinking it was a family member, but the next thing he knew he was being wrestled to the ground, police said.

The man said he was able to push Stoor and grab a handgun from his nightstand, but Stoor wrestled the gun away and threw it on the floor before putting him in a chokehold, according to the report.

The female witness was able to push Stoor off the victim. Stoor then slammed the door and fled — but not before stealing an acoustic guitar valued at approximately $400, according to court records.

The female witness told officers Stoor was her ex-boyfriend, police said.

Officers learned Stoor drove a maroon Chevrolet pickup with a white camper shell, and dispatch located a vehicle matching that description registered to him, according to the report.

Surveillance video obtained from a neighbor across the street showed Stoor knocking on the upstairs apartment door before entering at approximately 1:50 p.m. and leaving at 1:53 p.m. with a brown guitar in hand, police said. The video then showed him returning to the residence without the guitar and slashing the man’s truck tire before walking away, according to the report.

Officers conducted a walk-through of the apartment with the man to check for broken and stolen items, police said. The man said a brown acoustic guitar worth approximately $400 had been taken from a stand in his room and that the slashed truck tire was worth approximately $500, according to the report. His closet door had also been broken during the altercation, police said.

Officers were later notified that Stoor might be at a family member’s residence, according to the report. An investigator observed a maroon Chevrolet Silverado with a large camper shell parked in front of the address and watched a man exit the residence and walk to the vehicle, police said.

Multiple marked units from the Chubbuck and Pocatello police departments arrived and took Stoor into custody, police said. A guitar was found in his vehicle under a blanket and secured as evidence, according to the report.

Stoor was then arrested and transported to the Bannock County Jail in Pocatello.

Stoor appeared before 6th District Magistrate Judge David A. Hooste for an arraignment hearing Wednesday, where his bond was set at $5,000.

He is scheduled to appear in court again May 26 for a preliminary hearing. Prosecutors will attempt to present sufficient evidence to elevate the case from magistrate to district court for trial.

If convicted of felony burglary, Stoor faces no less than one year and up to 14 years in prison and a fine of up to $50,000.

The felony aggravated assault charge carries a sentence of up to five years in prison and a fine of up to $5,000 if he is convicted.
