POCATELLO — A 40-year old convicted felon was recently arrested after police say he raped and sexually abused a 12-year-old girl earlier this month.

Gonzalo Enrique Guerrero, of Pocatello, has been charged with rape, child sexual abuse, lewd conduct and two counts of unlawful possession of a firearm, all felonies, following a Pocatello police investigation launched on Oct. 11, according to police and court records obtained by the Idaho State Journal.

Guerrero is accused of performing sexual acts on the victim at a Pocatello residence after encouraging her to consume several alcoholic beverages, police said.

He allegedly ignored the girl’s numerous pleas for him to stop and the victim was only able to receive help after escaping into the home’s bathroom where she phoned for police.

Shortly after midnight on Oct. 11, emergency medical personnel and police responded to the home. The girl was transported via ambulance to Portneuf Medical Center and Guerrero was transported to a temporary holding cell at the Pocatello Police station for interrogation, the report said.

During his interrogation, Guerrero became emotional, denied the incident and then became highly distressed and agitated, striking the walls and floor with his hands, police said.

Officers executed warrants to obtain a DNA sample from Guerrero and to search the home where police located two firearms, an AR-15 rifle and a Taurus 9mm handgun, the report says.

As a convicted felon with prior convictions for controlled substance offenses in Missouri in 2006 as well as Texas in 2007, 2012 and 2014, Guerrero is legally prohibited from possessing any firearms, police said.

Guerrero was subsequently charged, arrested and transported to the Bannock County Jail in Pocatello.

He appeared before 6th District Magistrate Judge Eric S. Hunn for an arraignment hearing on Monday, where his bond was set at $1 million on the rape and sexual abuse charges and $500,000 for the lewd conduct and firearm charges.

Guerrero is scheduled to appear in court again on Oct. 28 for a preliminary hearing. Prosecutors will attempt to present sufficient evidence to elevate the case from magistrate to district court for trial.

If convicted, the rape and lewd conduct charges both carry a maximum penalty of up to life in prison, the sexual abuse of a child charge carries up to 25 years and both of the unlawful possession of a firearm charges carry up to five years in prison. He also faces up to $160,000 in fines.
