BLACKFOOT - A Blackfoot police officer who declared his candidacy for a seat on the City Council Sept. 4, has withdrawn his application, according to an official.
Officer Randy Herbert withdrew his name on Wednesday in light of the Attorney General Office's opinion that he would be required to resign from the police force if he were elected to serve on the City Council.
Deputy Attorney General Brian Kane said that if Herbert simultaneously held both positions, it would create a conflict and could be in violation of Idaho code.
He said because Herbert would report to the Blackfoot Police Chief as an officer while simultaneously determining the chief's authority.
City Clerk Suzanne McNeel said Herbert submitted a letter along with his notice of his intent to withdraw from the race.
In the letter of withdrawal, Herbert said he regretted the decision, but following the Attorney General's opinion, it was the best option for his family.
