POCATELLO — The case of Torey Adamcik, one of two former Pocatello High School students convicted of killing their classmate Cassie Jo Stoddart in 2006, will be back in 6th District Court on Friday.
Bannock County Deputy Prosecutor Ian Service said the post-conviction relief hearing will determine if Adamcik’s civil rights were violated when he was convicted of the murder.
Stoddart was found stabbed to death inside the home of a relative who she was house sitting for. She sustained 29 wounds during the attack.
In separate trials, Adamcik and Brian Draper were both found guilty of the first-degree murder of Stoddart, who was 16 at the time of her death. The teens were sentenced to life in prison without the possibility of parole.
Service said Adamcik has exhausted his criminal appeals and is now pursuing civil action.
“(Adamcik) is seeking a new trial or a new sentencing based on several claims,” Service said. “I am asking for a summary dismissal of all claims — it should be dismissed.”
The post-conviction relief hearing will be conducted by Sixth District Judge Mitchell Brown at 1:30 p.m.
Adamcik claims that the sentence passed down by retired Sixth District Judge Pete McDermott is cruel and unusual, and he states that his counsel was ineffective in his case.
In 2010, MSNBC aired a documentary, “In Coldest Blood,” that profiled the murder case and in 2013, Adamcik’s mother, Shannon Adamcik, published a book about the murder titled, “The Guilty Innocent.”
Shannon has maintained that her son might have been guilty of many things, but she does not believe he took part in the fatal stabbing. She could not be reached for comment Thursday.
During Torey’s trial, prosecutors showed a video recorded by Torey and Draper as they planned the murder and listened to Pink Floyd.

I am sorry for all parties involved! Truly a tragic case! Cassie Jo is gone! Her mother has Her no more. Even IF Tory didn't participate in the stabbing he sought nothing for Cassie!!!! Think about it the rest of your days! Justice served!
Again, I maintain from an informed point of view, Torey is innocent. I was in court for the trial, and there were many missteps by both the defense and the prosecution. I was involved from day one and saw things most did not.
Yes, Cassie is gone and for that I am truly sorry, but Keeping Torey in prison for something he didn't do will not make anything right.
Hate and Revenge serve no purpose other than to continue the pain all concerned suffer.
My thought on this is that his mother is scared for him being in prison and all. Well my opinion is he did a horrible murder and since he exhausted all his appeals that he should be denied for another trial. It's been 8 years and yes he had alot of thinking but still shouldn't be able to have another trial. That girl is gone and can't come back to us. So he should stay there in prison til he dies. His mother is in denial and that's understanding but she should move on and let him rot.
There was a lot of missteps in his trial. I dont know if he is guilty or not. But he must be granted another trial. His trial was a farce. There were so many laws broke when they were even interviewing him before he was arrested. Like I said I am not saying he is guilty or not guilty. But the justice system has to work the right way.
I say our Honorary McDermott was very humane in sentencing this disgusting assistant to cruel and demonic ways. Sorry to his mom for her having him in her life still.... Oh wait Cassie's family cant and your son is half the reason so just accept it and go about the fact he is alive. people are truly so dimwitted.

I feel so bad for all families involved. Adamcik's mother is unable to accept and process what her child did and is coping based on the child SHE knew and is unable to accept what he ultimately did, and the Stoddard family lives it daily as well. I get tired of seeing people badmouthing any of the family members; everyone deals with grief and processes ugly situations in there own way - but none have done anything wrong. The only two people deserving of punishment are in prision (hopefully) for the rest of their lives.
He was there and made no attempt to stop this horrible crime I do believe he helped with this vicious attack on this beautiful girl and deserves what he received for a sentence. He and his family are crying unjust punishment. What about Cassie and the unjust that was done to her!? .. Let them sit in and prison and rot
This is a clear case where capital punishment should have been his sentence and should have already been carried out and be done with him !!!
