POCATELLO — Attorneys for Torey Adamcik, one of two men charged for the murder of their friend and classmate, Cassie Jo Stoddart, in 2006, will be back in court Tuesday asking that Adamcik be granted a new trial — or at least a new sentence for his role in the murder of Stoddart.

Adamcik was convicted of the murder in 2007 along with Brian Draper. 

Both were 16 years old at the time. 

Earlier this month, the knives used in the killing of Stoddart were collected and sent for additional testing at the request of Adamcik’s attorney, Dennis Benjamin of Boise.

Benjamin, part of the firm of Nevin, Benjamin, McKay and Bartlett, specializes in post-conviction releases, and he contends that Adamcik’s defense in 2007 did not introduce evidence that could prove that he was not responsible for the fatal wound.

Benjamin also argued that Adamcik’s defense team did not produce expert testimony to show that just one knife was used in the killing of Stoddart and they did not attempt to obtain the two weapons taken into evidence.

Stoddart was stabbed 29 times; six of those wound were lethal.

Adamcik was initially represented by Aaron Thompson, Greg May and Bron Rammell, all of Pocatello.

In October, Bannock County Deputy Prosecutor Ian Service said the defense team acted responsibly and provided a solid, reasonable defense for Adamcik. Service added that the Idaho Supreme Court upheld the conviction and sentences of both Adamcik and Draper during the criminal appeal process.
