Former prosecuting attorney Robin Dunn signed a plea agreement on June 7 for drug-related charges brought against him by a federal grand jury in September 2023, according to court documents filed on June 11. The deal can result in an incarceration period of three and a half years.
The charges Dunn was indicted for included one count of conspiracy to distribute fentanyl and methamphetamine, two counts of possession with the intent to distribute fentanyl and methamphetamine, and one count of distribution of methamphetamine. Dunn pled not guilty to all charges following his arraignment last year.
According to the filed agreement, Dunn will plead guilty to count one of the indictment, which charges him with conspiracy to distribute; upon his guilty plea, his remaining counts two, three, and four will be dismissed and the United States will recommend a sentence of 42 months incarceration.
The agreement waives Dunn’s right to continue to plead not guilty on his charges, and waives his right to a trial by jury and all rights related to a jury trial.
The signed agreement outlines a factual basis, which by signing, Dunn has admitted to be true. This factual basis states that in the time period beginning about June 2022 until about February 2023, he agreed with three unnamed co-conspirators to distribute controlled substances. During this time he assisted with the trafficking of methamphetamine and fentanyl and later arranged travel to Salt Lake City to purchase said substances and transport them back to Idaho where they further distributed the drugs to others.
According to the document, Dunn knowingly possessed these substances in Idaho and intended to distribute it to others. At a later date, he traveled to Salt Lake City again to purchase and bring back to Idaho. Between Nov. 4, 2022, and Nov. 25, 2022, the documents state, Dunn caused the fentanyl to be distributed into the Bonneville County Jail to an unnamed co-conspirator who was both an inmate and a client of his law practice.
“The defendant agrees he abused a position of trust by using his position as an attorney to further his drug trafficking activities,” the signed agreement states.
Dunn’s plea agreement was filed following the third continuance of a jury trial for Dunn on these charges, and in April, his trial was rescheduled to take place in November. All three continuances were filed and granted for reasons related to voluminous amounts of discovery, or evidence, in this case.
“The defense received the latest discovery production on or about March 25, 2024,” court documents filed in April stated. “This discovery exceeds a terabyte of information.
Dates for Dunn’s change of plea hearing and subsequent sentencing have not yet been set.
