POCATELLO — Bannock County Prosecutor Steve Herzog said he plans to review autopsy and police reports and then meet with the family of Noelle Aston Shawver, the 5-year-old girl killed in an accidental shooting July 30, before deciding if criminal charges will be filed in the case.

    Shawver and her family, who live in Blackfoot, were visiting a home on the 600 block of Canal Street in Chubbuck when, according to police reports, another 5-year-old child accessed a firearm and accidentally shot Noelle. She died later that same day from her injury.  

    Herzog said he plans to meet with the family by mid-January and criminal child endangerment charges could be filed in the case.

    “You want to be respectful of the desire of the family, but you also have to look out for the good of the community. You need to send a message,” Herzog said.

    Herzog said Noelle’s family could also file a civil suit in the case.
